1.

ELIGIBILITY: The Foldees.com Greeting Card Design Contest (“The Contest”) is open to anyone aged 13 and above as of the start date of the Contest.

2.
|
ORGANIZER: : The Contest is organized by Energon Sdn Bhd (Company No:786967-X).
|
|
3.
|
AGREEMENT TO OFFICIAL RULES: Participation in the Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Organizer, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein. The Organizer reserves the right to terminate this Contest at any time.

CONTEST PERIOD: The Contest Period consists of the Submission Period and the Rating Period. The start and end dates of the Contest Period are stated on the Foldees.com Contest Page

SUBMISSION: During the Submission Period, go to http://www.foldees.com (“the Website”) to submit a design for the Contest. You may enter as many submissions as you wish. However, each Contest winner will only be eligible to receive one (1) Prize in relation to the Contest.
Contest Submissions cannot be revised or altered once submitted. Incomplete or inaccurate entries are void. All Submissions are subject to the Foldees.com general Submission Terms and Conditions found at http://www.foldees.com/terms_submission.aspx. Moderation of all Submissions will be performed by the Organizer according to these Submission Terms and Conditions.
By submitting your Submission, you agree to release and hold harmless the Organizer and its officers, directors, employees, and agents from and against any claim or cause of action arising out of your Submission or your participation in any phase of this Contest.
Any Submissions received during the Submission Period may be used by the Organizer for promotional purposes including but not limited to inclusion in any printed and electronic media, without prior consent from entrants and without any further consideration in the form of any payment or royalties. For clarity, this is only applicable for promotional materials not sold for commercial profit prepared by the Organizer. Submissions that are sold on the Website following the Contest Period will still be eligible for royalties in accordance with the Foldees.com general Submission Terms and Conditions.

JUDGING: Winners will be selected by other users of Foldees.com by means of a rating system and the ability to rate Submissions will be open to all registered users of Foldees.com during the Rating Period.
Potential winning Submissions will have to meet a required minimum number of ratings, the number of which will be determined by the Organizers at the end of the Contest Period.
The Submissions that receive the highest ratings at the end of the Rating Period will receive prizes in ascending order i.e. the Submission with the highest rating will receive the First Prize, the second highest rating will receive the Second Prize and so on, subject to these Submissions meeting the minimum number of ratings.
In the event of a tie or any other dispute, the Organizer will decide the list of winners. Decisions of the Organizer are final. Winning Submissions will be announced on the Website after the Ratings Period.

REQUIREMENTS OF THE POTENTIAL WINNER: Potential Winners will be notified if his/her Submission has been selected as one of the winning Submissions. Potential Winner is not a winner until he/she has returned all required documentation and eligibility has been verified by the Organizer. Potential Winner must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. If a Potential Winner cannot be contacted within three (3) days after the first attempt to contact him/her, the Submission with the next highest rating will be deemed the next Potential Winner.

PRIZES: The prizes will be distributed in the form of cash and/or gift prizes as stated on the Foldees.com Contest Page
here.
Cash prizes will be remitted to contest winners in United States Dollars wherever possible. For cash prize winners that are not able to receive the cash prize in United States Dollars, the cash prize will be remitted in whichever applicable currency at the mid-market rate stated at http://www.xe.com/ucc/ on the date winners are announced.
For gift prizes, Organizer disclaims all warranties, including, without limitation, any warranty of merchantability or warranty for a particular purpose. No cash or other substitution may be made, except by the Organizer, who reserves the right to substitute a gift prize with a cash value based on the market value of the gift prize obtainable by the Organizer or another gift prize of equal or greater value, if the gift prize is not available for any reason as determined by the Organizer at its sole discretion. The winner is responsible for any taxes and fees associated with receipt or use of any cash/gift prize.

GENERAL CONDITIONS: In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Organizer may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b) award the prizes at random from among the eligible Submissions received up to the time of the impairment. The Organizer reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Organizer reserves the right to seek damages from any such person to the fullest extent permitted by law. The Organizer's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In case of a dispute as to the owner of Submission, the Submission will be deemed to have been submitted by the authorized account holder of the screen name from which the Submission is made. The authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Contest, entrants agree to release and hold harmless Organizer from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Contest or the processing of Submissions; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt or use of any prize. Entrant further agrees that in any cause of action, the Organizer' liability will be solely limited to the cost of entering and participating in the Contest, and in no event shall the Organizer be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court in Malaysia. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Organizers in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Malaysia.

CONTEST RESULTS: To request the list of winners, send a self-addressed stamped envelope citing the title of the Contest to: Foldees.com Greeting Card Design Contest, 11, Jalan SS22A/6, Damansara Jaya, 47400, Petaling Jaya, Selangor, Malaysia. Requests must be received ten (10) days after the date winners are announced on the Website.
